<h3>9 Reasons S. 3002 Has to Go</h3>

<p>1. No phase-in period or “effective date”. Since legitimate dietary supplement companies and health-food stores would not have even one day to come into compliance with the new law, they would effectively be breaking the law the day after S. 3002 is passed.</p>
<p><span id="more-174"></span></p>
<p>2. Registration of supplement licensors. S. 3002 would require outfits that license dietary supplements to register their “facilities” under the FDA Food Facility program established by the Bioterrorism Act of 2002. Including these requirements would go against the purposes of the Bioterrorism Act and would serve no useful purpose other than creating more bureaucracy and red tape.</p>
<p>3. Registration of health-food stores. S. 3002 is unclear as to whether the current retailer exception to the Bioterrorism Act registration requirement is intended to be honored for supplement retailers.</p>
<p>4. Product and ingredient registration. The product/ingredient registration process included in S. 3002 is unclear in its use of the terms “ingredients” and “labeling.” As worded, S. 3002 would apparently require duplicate, therefore unnecessary, registration of every product at every point in its distribution! This would be an incredible burden, one that would mandate annual updates, and one that would not protect any proprietary information that is not required on product labels but that that may be required to be submitted in the registration process.</p>
<p>5. Replacement of new dietary ingredient (NDI) requirements with an FDA positive list. FDA received information between 1996 and 1998 from dietary supplement trade associations to record ingredients believed to be marketed in the U.S. prior to the passage of DSHEA. If there is any lack of clarity as to what dietary ingredients are “old,” the agency should initiate rulemaking to formally adopt the ingredients directly submitted by the trade associations.</p>
<p>6. Retailer evidence of compliance. The bill’s proposal to require health-food stores to obtain evidence of compliance with product registration and NDI notifications is would be ridiculously burdensome and something that is not required for other regulated goods.</p>
<p>7. Civil penalties. The bill would establish new, unnecessary civil penalties despite the fact that current law already imposes adequate fines and penalties for violations of the Food Drug and Cosmetic Act.</p>
<p>8. Non-serious adverse event reports. The FDA itself has made it clear that it would not be helpful for the agency to receive boatloads of minor or trivial (and probably not substantiated) adverse event reports associated with dietary supplements. Under current law, dietary supplement companies are already required to maintain records of all adverse event reports for 6 years and the FDA has the authority to inspect these records at any time.</p>
<p>9. FDA recall and “cease distribution” authority. S. 3002, as well as other food safety legislation already introduced in the 111th Congress (such as S. 510), would provide FDA with authority to mandate products recalls when health risks are presented by marketed products, which is fine. However, what is not fine is that S. 3002 would obligate the agency to issue a “cease distribution” order for any supplement identified as adulterated or misbranded, even in the absence of any perceived health risk.</p>

<p>Water has a very important message for us. Water is telling us to take a much    deeper look at our selves. We know that human    life is directly connected to the quality of our water, both within and all around us.</p>

<p><span class="style3"><big><big>How the molecular structure of water is affected&#8230;</big></big></span></p>
<p>From Mr. Emoto&#8217;s work we are provided with factual evidence, that human vibrational    energy, thoughts, words, ideas and music, affect the molecular structure of water, the very same water that comprises over seventy percent of a mature human    body and covers the same amount of our planet. Water is the very source of all    life on this planet, the quality and integrity are vitally important to all forms of life. The body is very much like a sponge and is composed of trillions of chambers called cells that hold liquid. The quality of our life is directly connected to the quality of our water.</p>
<p>Water is a very malleable substance. Its physical shape easily adapts to whatever    environment is present. But its physical appearance is not the only thing that    changes, the molecular shape also changes. The energy or vibrations of the environment    will change the molecular shape of water. In this sense water not only has the    ability to visually reflect the environment but it also molecularly reflects    the environment. Mr. Emoto has been visually documenting these molecular changes in water by    means of his photographic techniques. He freezes droplets of water and then    examines them under a dark field microscope that has photographic capabilities.    His work clearly demonstrates the diversity of the molecular structure of water    and the effect of the environment upon the structure of the water.</p>

<p>Snow has been falling on the earth for more than a few million years. Each snowflake,    as we have been told, has a very unique shape and structure. By freezing water    and taking a photograph of the structure, as Mr. Emoto has done, you get incredible    information about the water.</p>
<p>Mr. Emoto has discovered many fascinating differences in the crystalline structures    of water from many different sources and different conditions around the planet.    Water from pristine mountain streams and springs show the beautifully formed    geometric designs in their crystalline patterns. Polluted and toxic water from    industrial and populated areas and stagnated water from water pipes and storage    dams show definitively distorted and randomly formed crystalline structures.</p>

<p>With the recent popularity in music therapy, Mr. Emoto decided to see what    effects music has on the structuring of water. He placed distilled water between    two speakers for several hours and then photographed the crystals that formed    after the water was frozen.</p>

<p>After seeing water react to different environmental conditions, pollution and    music, Mr. Emoto and colleagues decided to see how thoughts and words affected    the formation of untreated, distilled, water crystals, using words typed onto    paper by a word processor and taped on glass bottles overnight. The same procedure    was performed using the names of deceased persons. The waters were then frozen    and photographed.</p>

The not-for-profit group lists the “Dirty Dozen” (the 12 fruits and veggies that are the most contaminated with pesticides) and the “Cleanest 12? (those that generally have the lowest amounts of pesticides).</p>

<p>To come up with its rankings, the Environmental Working Group looked at the results of close to 43,000 tests for pesticides on produce by the U.S. Department of Agriculture and the U.S. Food and Drug Administration. A computer analysis by the EWG found that consumers could reduce their pesticide exposure by nearly 90 percent by avoiding the most contaminated fruits and vegetables and eating the least contaminated instead. People who eat the “Dirty Dozen” will be exposed to an average of 15 different pesticides per day, says Richard Wiles, executive director of the Environmental Working Group, while eating from the “Cleanest 12? means you’ll be exposed to less than two pesticides per day. So if produce from the “Dirty Dozen” is on your menu, it makes sense from a health standpoint to choose organic.</p>
<p>Of course, health concerns aren’t the only reasons people choose organic foods. It takes an enormous amount of fuel to make synthetic fertilizers, explains Wiles. “Conventional agriculture is very energy inefficient,” he says.</p>
<p>On the other hand, costly and polluting fuel is required to transport both conventional and organic fruit and vegetables from farms to grocery stores — produce is often shipped to the U.S. from as far away as New Zealand. So does this mean you’re better off eating a locally grown nonorganic apple than an organic one from the other side of the world? Perhaps the solution, Wiles says, is to encourage local farmers to start growing organic crops. For example, begin by asking farmers whether they used pesticides on their apples, Wiles advises. “The more that local production can be moved toward organic, the better,” he says.Meanwhile, even if you can’t always afford or find organic produce, there are steps you can take to get rid of some of the pesticides on conventional produce. Since washing reduces pesticides by anywhere from one third to one half, thoroughly scrub and rinse everything, even produce that will be peeled. Then consider making yourself a pesticide-reduced dinner tonight.How does a menu of Guacamole, Tropical Fruit Salsa, and Cilantro-Lime Chicken Fajitas with Grilled Onions sound?</p>
